Federal Judge Beverly B. Martin for the Northern District Court of Georgia granted a Motion for More Definite Statement filed by Dennen Ragano on behalf of 11 Defendants. Consistant with the Motion, the Court deemed the cause of action a "shotgun" complaint, and required the Plaintiff to re-plead the matter. Rather than file an amended complaint, the Plaintiff Voluntarily Dismissed the matter. The matter settled out of court against all but one of the 11 Defendants. Dennen Ragano is pleased to announce an important appellate victory achieved on behalf of one of our clients. In a case of first impression, on May 13, 2009, the Second District Court of Appeals upheld the trial courts' dismissal of a contribution action against one of our clients. The opinion constitutes the first time a Florida appelate court has ruled on the issue of contribution after the abolishment of the doctrine of join and several liability in negligence cases. In affirming the trial court's dismissal of the third party complaint, the 2d DCA ruled that a contribution action against a third party is unnecessary in negligence causes of action as a Defendant will only be responsible for its pro rata share of common liability. Federal Judge James Lawrence King for the Southern District of Florida dismissed with prejudice a claim for breach of the covenant of good faith and fair dealing against a Dennen Ragano client. Dennen Ragano achieved its first appellate victory today. The Second District Court of Appeal upheld a trial court's coverage decision in favor of Dennen Ragano, PLLC's insurance client.
